Do I Need An Attorney To Draft A Separation Agreement in North Carolina?

When we're talking about separation agreements, people frequently ask, "Can I do it myself or should I have an attorney to do it for me?" You can certainly do one yourself. A separation agreement is a contract between you and your spouse that you both signed and has to be notarized. It cannot be an oral contract. You have to write everything down and it has to be notarized. Otherwise, it's not enforceable.

Now, the question of whether you should be the one doing it or you should have an attorney to do it, that's a very important question. There's really only one that you and your spouse can decide on.

The one thing you should know is if you sign a separation agreement, the court is very unlikely to set it aside. You're going to be stuck with those terms for the rest of your lives. If it deals with things like alimony or child custody or child support, you may want to consult an attorney before you enter into an agreement that's going to affect you for the years to come. I really recommend that even if you decide to draft it yourself, you have an attorney review it before you sign it. That can save you a little bit of money if that's the way you want to go.

Certainly, we are always here to draft them for you if you need us to. Just tell us as to how we can help.
